By accessing, browsing, or using ExplainMyRights (the "Service"), operated by Seekefy (Pty) Ltd, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must immediately cease using the Service.

2. Service Description

ExplainMyRights is an educational and informational service that provides:

• General legal information based on South African law and legal precedents
• AI-generated guidance with automated verification and confidence scoring
• Citations to legal sources from SAFLII (Southern African Legal Information Institute) databases when available
• Hallucination detection technology to minimize inaccurate or fabricated information
• Comprehensive audit trails with unique Audit IDs for quality assurance and accountability

Important: The Service is designed for general educational purposes and preliminary research only.

3. Limitations of Service

Users must understand and acknowledge the following critical limitations:

• Not Legal Advice: The Service does not provide legal advice and does not create an attorney-client relationship
• No Guarantees: We do not guarantee the accuracy, completeness, timeliness, or suitability of information for your specific situation
• AI Limitations: Despite verification measures, AI systems can produce errors, inaccuracies, or "hallucinations" (fabricated information)
• Always Verify: All information must be independently verified with official legal sources and qualified legal professionals
• No Reliance: You must not rely solely on ExplainMyRights for any legal decisions affecting your rights or obligations
• No Representation: Using this Service does not constitute legal representation in any matter
• Changing Laws: Laws change frequently; information may become outdated between updates

4. User Responsibilities

By using the Service, you agree to:

5. Intellectual Property Rights

All content, including but not limited to:

• Software, algorithms, and AI technology
• Trademarks, logos, and branding (ExplainMyRights, Seekefy)
• User interface design and functionality
• Documentation and training materials

are owned by Seekefy (Pty) Ltd and protected by South African and international intellectual property laws. You may not:

• Reproduce, distribute, or create derivative works without written permission
• Use our trademarks or branding without authorization
• Reverse engineer, decompile, or attempt to extract source code from our AI systems
• Claim ownership of AI-generated responses

6. Limitation of Liability

To the fullest extent permitted by South African law:

• Seekefy (Pty) Ltd, its directors, officers, employees, and agents shall NOT be liable for any damages arising from:
  • Reliance on information provided by ExplainMyRights
  • Errors, omissions, inaccuracies, or outdated information in responses
  • Service interruptions, downtime, or technical issues
  • Loss of data, privacy breaches, or unauthorized access
  • Legal consequences of actions taken based on the Service
  • Decisions made without consulting a qualified attorney
• In no event shall our total liability exceed the amount paid by you (if any) for using the Service in the 12 months preceding the claim
• We disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose

7. Indemnification

You agree to indemnify, defend, and hold harmless Seekefy (Pty) Ltd from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms of Service
• Your violation of any third-party rights, including intellectual property rights
• Any legal consequences resulting from actions taken based on Service information

8. Modifications to Terms

We reserve the right to modify, amend, or update these Terms of Service at any time without prior notice. Changes will be effective immediately upon posting on this page with an updated "Effective Date." Your continued use of the Service after changes constitutes acceptance of the modified terms. We recommend reviewing these terms periodically.

9. Service Modifications and Termination

We reserve the right to:

• Modify, suspend, or discontinue any aspect of the Service at any time
• Terminate or suspend your access to the Service immediately, without notice, for:
  • Violation of these Terms of Service
  • Fraudulent, illegal, or abusive activity
  • Misuse of the Service or attempts to compromise security
  • Any reason at our sole discretion

Termination does not affect any rights or obligations that accrued prior to termination.

10. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from or related to these terms or the Service shall be resolved exclusively in the courts of South Africa. You consent to the personal jurisdiction of such courts.

11. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

12. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Seekefy (Pty) Ltd regarding the use of ExplainMyRights and supersede all prior agreements, understandings, and communications.

13. No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Seekefy (Pty) Ltd.

14. Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

15. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or governmental actions.
